"where it is apparent that, in practice, all the users of a medium rarely use such a function, the making available of that function may not, as stated in recital 35 in the preamble to Directive 2001/29, give rise to an obligation to pay fair compensation, since the prejudice to the rightholder will be regarded as minimal."
